Ethics and law are not the same thing

Typically, the law tells us what we are prohibited from doing and what we are required to do. It is said that the law sets minimum standards of behavior while ethics sets maximum standards.

Ethics provides us with guides on what is the right thing to do in all aspects of life, while the law generally provides more specific rules so that societies and their institutions can be maintained. Ethics engages our thinking and also our feelings, including those of disgust and guilt.

MORE IDEAS FROM THE ARTICLE

Ethical behavior is not always best defined within the confines of the law.

Something may be legal but we may consider it unacceptable. And we may consider something right but it may not be legal. Many companies are facing a public backlash for not paying adequate tax in a number of jurisdictions. While this may not be an illegal activity, it is considered wrong and we are looking to the law to make sure it does not allow it.

The Four Universal Principles
  1. Accountability - The government and private actors are accountable under the law
  2. Just Law - The law is clear, publicized, and stable and is applied evenly
  3. Open Government - The processes by which the law is adopted, administered, adjudicated, and enforced are accessible, fair, and efficient
  4. Accessible and Impartial Justice - Justice is delivered timely by competent, ethical, and independent representatives and neutrals

The four universal principles constitute a working definition of the rule of law. These were developed in accordance to internationally accepted standards and norms.

Legal standards would often ask what the 'reasonable person' would do. But we should consider who this person is.

The reasonable person is not the average person as average people can do unreasonable things; neither is it the ideal person. Instead, the reasonable person represents someone common as well as good.

Friends are tied to each other through emotions, customs, and norms. With social media, we can share information about our friends without their permission and legal restrictions. We can share information even beyond our friendship network.

As we apply for jobs, prospective employers will likely use social media to learn about us and judge us. Therefore, what our friends show to the world matters.
